Poole Quarter – Freedom Bill 2010

The Coalition Government have recently announced that wheel clamping on private land is to be banned in England and Wales as part of the new Freedom Bill. This new legislation is due to be heard before Parliament in the autumn and it is hoped that Royal Assent will be given soon after whereby the Bill would become an Act of Parliament and thus law.

The new law will make vehicle clamping, immobilisation and the towing of vehicles parked on private land illegal. These changes will therefore impact upon the enforcement of the new parking permit system on Poole Quarter.

Once the Bill becomes law parking enforcement on Poole Quarter will be undertaken using fixed penalty notices instead of clamping. These penalty notices are legally enforceable in the same manner as those issued by traffic wardens and non payment could result in legal proceedings being undertaken.

It should be noted that the changes outlined above do not impact upon clamping undertaken by the Borough Council or the Police in respect of indiscriminately parked vehicles on the adopted highway.

Until the new law is in place clamping on Poole Quarter will continue as advised by the on site signage.
